TERMS & CONDITIONS 2019

Sailing tours - Yacht charter rates are in Euro and include: Current VAT 12% (50% discounted rate on the full 24% VAT applicable), fuel, crew (if crewed charter), drinks and food as notified.
Sailing tours - Yacht charter rates do not include: transfers, crew gratuities and extras. Travel services: Transfers can be arranged upon request. If you would like to add the transfer service after the completion of your reservation you may do so by contacting our reservations department. Passengers are responsible for ensuring that they are waiting at the designated pickup location as per the confirmation provided, namely during the correct time window and in the correct place.
Extras by independent providers, subject to availability, are payable prior to embarkation directly by Charterer in cash.
Prices include local taxes and VAT calculated as per current rates applicable and valid to this date, subject to change without prior notice or responsibility of the Broker, the Stakeholder or the Supplier. Should any changes in applicable tax legislation take place after booking, that result in change of VAT and hence of total amount(s) due, then the difference will be credited or debited accordingly to the Charterer.
Yacht Insurance: All boats are insured against: Risks arising from liability to third parties and damage to hull, machinery and equipment; Third party liability;
Sea pollution liability. A deductible provision is applied, depending on the yacht’s value.
We reserve the right to implement alternate locations, other than the itinerary due to force majeure, weather conditions, or imposed safety limitations.
It is the passenger’s responsibility to assert whether he/she is physically fit to ride on a boat and will not hold the vessel and/or Michael Matsakis, Mykonos Cruising or their employees, agents or other associated personnel, responsible if he/she is injured as a result of ANY problems (medical, negligent, accidental or otherwise) which occur while chartering the boat or otherwise participating in the trip. It is the passenger’s responsibility and duty to exercise reasonable care for his/her own safety. Passengers must fully understand that the vessel has limited medical facilities and that in the event of illness or injury, appropriate care must be summoned by radio and treatment will be delayed until they can be transported to a proper medical facility. Reasonable measures will be taken for immediate medical assistance.

Payments: 50% of the total charter fee due and payable upon reservation to confirm booking. Balance payment due prior to embarkation.
Booking is not confirmed until 1st payment is cleared to Michael Matsakis Individual Company bank account stated on booking form. The sailing tour will take place only if all payments are confirmed in cleared funds in due time. All payments are in Euro.
Passenger/s will receive a confirmation once the booking is complete. The Passenger/s is responsible for checking that the reservation details are correct, and advising of any errors immediately.

CANCELLATION POLICIES

1. Client's cancellation policy

If the client wishes to cancel the tour, the following policy applies:
Cancellation more than a week before the tour: full refund.
Cancellation between one week and two days before the tour: 50% refund of the full amount.
Cancellation less than two days before the tour: the total amount will be charged (no refund).
For cruise ship passengers, in case of a last minute cancellation due to an unexpected change of the cruise ship schedule (the ship finally doesn't stop in Mykonos): Full refund if you inform us immediately (and at least several hours before the tour)

In case of Force Majeure, war, pandemic, terrorist attacks, affecting the good performance of our services or the coming of our customer, the above policy is not valid.

2. Weather cancellation policy

Our starting point (Ornos Bay) is located on the south coast of Mykonos and it takes in account the prevailing local wind (blowing from north), this is why we can do our main itinerary comfortably with a wind up to 5-6 Beaufort.
With a wind of 7 Bft, instead of Rinia and Delos islands, we do our alternative itinerary: a tour along the south coast of Mykonos, visiting most of the south beaches and a nice cove away from the crowds. Kindly note that this itinerary is perfectly safe thanks to the proximity of the coast (no waves). There is no tour cancellation or refund.
With a wind ≥ 8 Bft we try to postpone to another day with better weather according to both sides availabilities and, of course, if it's not possible, we cancel with full refund.

3. Client's cancellation policy for a booking concerning two or more boats simultaneously

If the client wishes to cancel the tour, the following policy applies:
Cancellation more than one month before the tour: full refund.
Cancellation between one month and one week before the tour: 50% refund of the full amount.
Cancellation less than one week before the tour: the total amount will be charged (no refund).

4. Cancellation policy for long charters (overnight):

Booking confirmation: 50% deposit, balance the latest 30 days before the cruise.
Cancel 90+ days prior embarkation: 75% of the total charter is refunded (50% of the deposit is refunded).
Cancel up to 30 days prior embarkation: 50% of the total charter is refunded (we keep the deposit).
Cancel less than 30 days prior embarkation: no refund.

Information, photos and videos on Mykonos Cruising webpages are not binding and does not constitute contractual document. Mykonos Cruising is not responsible for any typing errors that may occur. Charterer and Agents acknowledge to have read, understood and agreed to the terms and conditions of booking. Charterer confirms acceptance without modification of all Charter Party Terms & Conditions and assumes full responsibility pursuant to those terms. In cases of complaints, notice must be given to Stakeholder by written communication specifying the precise nature of the complaint within 24-hours of the event. Any claim or complaint after such period, may be disregarded.
